1. Under Rule 801(d)(1)(A) of the West Virginia Rules of Evidence, a witness prior inconsistent statement is not hearsay and may be used as substantive evidence if it meets certain prerequisites. First, the statement must have been given under oath subject to the penalty of perjury at a trial, hearing, or other proceeding, or in a deposition. Second, the statement must be inconsistent with the witness testimony at trial, and the witness must be subject to cross-examination.
